I’m not a huge fan of the term “douche.” It’s an old college-feminism thang: why do the most dire insults to guys have to be closely associated with the feminine gender, and lovely lady parts? But, if I may: we have just pretty much defined the ultimate in dude douche-dom.

Video Submission Guidelines

Thank you for your interest in The Moment of Truth.  In order to be considered for this season’s hit show on FOX, please submit the following information:

Submit the attached application.  This form must be completed and signed.

Accompanying the application, please submit a video prepared by you along with your photograph.

The video must meet the following restrictions:

(a) LENGTH:  5 - 7 minutes (7 minutes maximum)

(b) FORMAT:  VHS or mini DV

.  DO NOT TAPE yourself in front of a blank white wall or window. 

.  Make sure you are positioned in front of the camera where you can be clearly seen from the top of your head to about your chest area.

.  Be sure you are in a well-lit room.

.  BEFORE SENDING – check your tape to make sure there is good      picture and sound.

(c) DEADLINE:  Submissions will be accepted, if actually received no later than April 1, 2008

(d) CONTENT:  Please include the following in your video: When answering the question, please incorporate the question first than give the answer for example:  Do you consider yourself an honest person?  I consider myself an honest person because I haven’t told a lie in 20 years.

APPLICATION RELEASE

 

In consideration, the receipt and sufficiency which is hereby I acknowledged, of ___________________________ (“Producer”) possibly selecting me as a contestant for the reality television pilot and/or series currently entitled “The Moment Of Truth” (working title) (the “Program”) intended for initial exhibit on the Fox Broadcasting Company network (the “Network”) and for other good and valuable consideration which I have received, I hereby agree as follows:

 

A.            Personal Release:  I hereby grant to Producer and its successors, licensees and assigns, without charge or other compensation, the irrevocable right, but not the obligation, with or without my knowledge, in perpetuity and throughout the universe, to film, tape, and/or photograph, record, exhibit, display, edit, distribute, sell, and otherwise use my name, appearance, likeness, voice, singing voice, conversations, sounds, biographical data, and any information or materials provided by me (including, without limitation, this Application, any photographs, videotapes (audio/visual) and/or other documents and information) to Producer in connection with and ancillary to the Program or otherwise in all media, whether now known or hereafter devised, including, without limitation, in the Program, motion pictures, television (including, but not limited to, free, pay, pay-per-view, cable, broadcast, subscription, video-on-demand, interactive, satellite, or community), home use formats (including, but not limited to, cassette, laser disc, DVD CD-ROM, or other means), radio (including, but not limited to, satellite and terrestrial radio), on the Internet (broadcasting and streaming), and other computer and wireless/cellular devices and digital transmissions to any interactive digital downloading and streaming media (including, but not limited to, CD-ROM and recordable DVD), non-theatrical (including, but not limited to, hotels, institutions, military establishments, embassies, in-flight and other transportation vessels), publishing, and recordings in connection with the advertising, sale, promotion, marketing, merchandising (including slot machines), distribution, publicizing and all other types of exploitation thereof, or in any manner whatsoever in Producer’s sole discretion, or to refrain there from.  Producer shall also have the unrestricted right to edit the content and text of the Program, as well as all film, tape, photography, recordings and my appearances thereon or materials submitted by me to Producer, in any manner or form.  I further agree that Producer is the sole owner of and may freely assign all results and proceeds of such film, tape, photography, recordings and my appearances thereon.  Furthermore, I acknowledge and accept that any materials submitted by me to Producer will become the sole and exclusive property of Producer and will not be returned to me. 

 

B.            Eligibility Requirements.  I have read and agree to be bound by the following eligibility requirements for the Program (the “Eligibility Requirements”):

 

I hereby represent and warrant: 

 

1. I am a United States citizen or a permanent legal resident of the United States and have the unrestricted right to work in the United States.

 

2. I am over the age of eighteen (18) years old and am not a minor in my state of residence. 

 

3. If I am, or have ever been a member of any performing arts union or guild, I agree that my participation as a contestant on the Program does not constitute a performance and/or an appearance as defined by any performing arts union or guild, nor does it entitle me to any wages or salary or other similar compensation. 

 

4. I am not, nor is any immediate family member (including unrelated persons living in the same household) an employee, shareholder, officer, director, agent or representative of Producer, Lighthearted Entertainment, Inc., Fox Broadcasting Company, News America, Inc., the background investigation company, psychologist, production staff and crew for the Program, participating television stations, advertising agencies, sponsors, or any person or entity connected with the production or administration of the Program (including the auditions and contestant selection process), or any of their respective parent companies, affiliates, subsidiaries, agents or representatives (collectively, “Producer Parties”).  To the best of my knowledge, I do not know anyone who is now or has been in the past two (2) years, an employee, agent or representative of any of the Producer Parties.   

 

5. I am not currently a candidate for public office and will not become a candidate for a period of twelve (12) months from the date of my appearance on the Program. 

 

6. To the best of my knowledge, I do not have a medical condition that might impact upon my health and well-being or the health and well-being of the other contestants or any other persons involved with the production of the Program. 

 

7. All of the statements and/or disclosures made by me in this Application are true and complete and I understand that if any of the statements and/or disclosures are false, then I may be disqualified from the contestant selection process or the Program itself. 

 

8. I will keep strictly confidential all information about the Program that I learn before, during or after my participation in the Program (including without limitation, the Program itself, the contestant selection process, the program-format, the game questions, the contestants and/or other participants, the outcomes, the winners and/or losers, etc.) and/or Producer’s legal and business affairs.

 

9. During the last twelve (12) months, I have not appeared in, am not currently appearing in and am not now under consideration for an appearance on any other reality television or Internet program.   I agree that I shall not apply, interview and/or audition for any other reality television or Internet program while I am under consideration for this Program and continuing for twelve (12) months from the initial telecast of the last episode(s) in which I appear if I am selected as a contestant for the Program.   
   
   
10. I am not currently under contract to any third party and subject to any contractual exclusivity obligations, which would prohibit me from appearing on the Program. 

 

11. If I am selected as a contestant for the Program, I will not enter into any personal, social, business and/or financial relationships with any of the hosts or production staff or crew of the Program during the period of time which is four (4) months from the initial airing of the episode(s) in which I appear.  In addition, I acknowledge and agree to notify my family members and friends regarding this provision and their obligations to comply herewith. 

 

12. I hereby acknowledge that the Producer is not under any obligation to record my contribution to the Program, if any, or include me in the broadcast version thereof.  

 

13. I understand and agree that I am prohibited from displaying any tattoos or wearing any clothing items, including, but not limited to, shirts, pants, shorts, and hats, that contain any recognizable logos (for example, designer, sports or any other logos) or any other copyrighted material (for example, a t-shirt with pictures or artwork) or bearing the name or likeness of any celebrity, living or dead, unless Producer has specifically provided such apparel to me. 

 

14. I shall not make any mention or "plug" of any commercial product, service, venture or thing on the Program, including the name of my employer.  I hereby acknowledge that neither I nor anyone acting on my behalf is giving or receiving any monies, or other valuable consideration to get me on the Program or mention anything on the Program.  I am aware that payment or acceptance of, or agreement to pay or accept, any money or valuable consideration for the appearance of any person or the mention of any thing on the Program without disclosure to the broadcaster prior to broadcast is a federal offense punishable by fine and/or imprisonment.  I agree that if anyone tries to induce me to accept any such payment, I shall immediately notify the Producer.

 

15. I am aware that it is a federal offense punishable by fine and/or imprisonment for anyone to do anything which would rig or in any way influence the outcome of the Program with the intent to deceive the viewing public and that it is a federal offense to offer or to accept any information or secret assistance in connection with the Program.  I agree that I will not participate in any such act or any other deceptive or dishonest act with respect to the Program.  If anyone tries to induce me to do any such act, I shall immediately notify the Producer.

 

C.            Release of All Claims/Indemnification.  To the maximum extent permitted by law, I hereby release, discharge, and hold harmless Producer and Producer Parties (collectively “Released Parties”), from any and all liabilities or claims arising out of or in any way resulting from my participation in the Program or in any aspect or phase thereof, the use or reuse of my name, appearance, likeness, voice, singing voice, biographical information or submitted materials, or the breach or alleged breach of any provision hereof and I agree not to make any claim against the Released Parties as a result of my participation or non-participation in the Program or in any aspect or phase thereof and in connection with any use or reuse of my name, appearance, likeness, voice, singing voice, biographical information or submitted materials (including, without limitation, any claim based upon defamation or invasion of privacy, publicity and/or intentional or negligent infliction of emotional distress).  In addition, I agree to indemnify the Released Parties and to hold each of them harmless from any and all liability, claim, action, damage, expense, and loss of any kind (including outside attorney’s fees) caused by or arising out of any breach or alleged breach of any provision hereof or any statement, action or failure to act by me during or in connection with my participation in the Program or otherwise.  Without in any way limiting the foregoing, in no event shall I have any right to seek injunctive or other equitable relief against any of the Released Parties.

 

To the maximum extent permitted by law, I waive any and all rights I may have under Section 1542 of the Civil Code of California, and every like provision in any foreign jurisdiction.  Section 1542 provides as follows:

 

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT

KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE,

WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT

 

D.            Consents and Authorizations:  I hereby authorize Producer and the Network to investigate, access, and collect information about me and any of the statements made by me in this Application and Release or otherwise in connection with the application/interview process or polygraph sessions.  I hereby authorize Producer and the Network to secure information from my current and former employers, associates, family members, friends, educational institutions, government agencies, credit reporting agencies, and any references I have provided or that are developed by or for Producer or the Network, and I authorize such parties to provide information concerning me.  I unconditionally and irrevocably release and forever discharge all Released Parties and persons from any and all claims, actions, damages, liabilities and losses arising out of or in connection with such investigations (including, without limitation, those who request information and those who provide any information).  Any information obtained by Producer or the Network may be used for (a) evaluation of my Application to participate in the Program, (b) selecting contestants and/or questions for the Program; and (d) for any other purposes.  Without in any way limiting the foregoing, any such information may be used, broadcast, exhibited, distributed, advertised, publicized, promoted or otherwise exploited as part of the Program or otherwise.  Furthermore, I understand and agree that any such information may be disclosed to other participants in the Program and may be disclosed on-camera.

 

E.             Miscellaneous. 

 

1.        This Agreement shall be interpreted under the laws of the State of California without regard to the conflicts of law provisions thereof.  If any controversy or claim arising out of or relating to this Agreement, or the breach of any term hereof, cannot be settled through direct discussions, the parties agree to endeavor first to settle the controversy or claim by mediation conducted in the Los Angeles, California.  If a controversy or claim is not otherwise resolved through direct discussions or mediation, it shall be resolved by arbitration conducted in Los Angeles, California, and administered by the American Arbitration Association (“AAA”).  The AAA Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in California.  I acknowledge that in no event will I be entitled to injunctive relief of any kind in connection with this Application and Release, including, without limitation, in connection with any breach of this Release.  The prevailing party hereunder shall be entitled to recover attorney’s fees and the proceedings and any award and/or judgment by the arbitrator shall remain confidential.  Any award and/or judgment granted hereunder may be confirmed in any court having jurisdiction hereof.     

 

2.        As used herein, “Producer” shall include Producer, its licensees, successors and assigns, and each of their respective parents, subsidiaries, and affiliates, and each of their respective officers, directors, shareholders, employees, agents, representatives, successors, licensees and assigns.  I agree that Producer may license, assign, and otherwise transfer this Agreement and all rights granted by me under this Agreement to any person or entity.

 

3.        This is the complete and binding agreement between Producer and me, and it supersedes all prior understandings and/or communications, both oral and written, with respect to its subject matter.  The illegality, invalidity or unenforceability of any provision of this Agreement shall in no way affect the validity or enforceability of any of the remainder of this Agreement, which shall be enforced to the maximum extent permitted by law.  This Agreement cannot be terminated, rescinded or amended, except by a written agreement signed by both Producer and me.
