I Guess We'll Never Write About Her Again

Posted by Emily Farris

Hey guys, I just got my first cease-and-desist letter! It was from "the people" of a certain bisexual reality TV star whose name I can no longer use because, apparently, it's trademarked.

Hilarious letter regarding this post after the jump.

I guess they're going to have to write me another letter if they want me to take down the post accusing her of being a Vegas call girl. In the mean time "my people" are looking into it.

Congratulations, Emily. You should celebrate.

Also, do you often have people refer to you as "Gentlemen"?

Fuck that. Don't worry about. Journalistic fair use. You can mention a registered trademark any time you review or talk about that product.

You should be proud of this, Emily. It means you actually got to Tila Tequila personally. Something you said really pissed her off.

Even though I kinda like Tila, it still feels good whenever you take those fuckers down a peg.

Correct me if I'm wrong, but are they saying the tag "Michigan" has to come down?!

Yeah, and I don't know why I didn't get the same letter about the Vegas call girl thing-- maybe they don't want to admit I was right.

By the way, did you notice they "CC" Tila Tequila here?

As if she can read...

A bit of poking on the internet indicates Pardo is something like a third-year associate at the Davis Firm, which is a small shop that apparently represents C-list celebrities.  IP is not my area (and I'm not giving you legal advice), but I'm not aware of any trademark case arising out of news reports and commentary.  If you were selling a product with her image, you'd have a problem.  On that theor, Coca-Cola could shut you down for saying you hate the taste of Diet Coke (which, of course, is trademarked) and for illustrating your commentary with a picture of a Diet Coke can.  I assume you didn't lift a copyrighted picture from her website, right?  (Which, if you did, would be a copyright issue, not a trademark issue.)

Bravo, way to go Scanner Emily,  Just remember that we now have the law firm's e-mail address and if things get too hot a campaign is now possible.  It looks like Molly Good also got a letter?  S.E. just upped her recognization factor.

Oh the irony. As if she would HAVE a career if not for continued blog mentions.

I'm with the lawyers on this one. No-one should ever mention Tila Tequila again.
