A Judge is under fire for allegedly asking an insulting question of the rape victim-- after the rapist had already been found guilty-- in the case's sentencing phase. What was so horribly wrong about that offhand remark that national news outlets are picking up the story?

The Houston Chronicle blog Hair Balls says it's something akin to "How did he rape you if you were on top?" (Think about how dumb this is for a second-- would you ask the victim the same question if it had been a blow job instead of vaginal penetration?)

Judge Kevin Fine may escape any penalties for his bizarre question because, well, he's a judge-- he can get away with that kind of thing, particularly since so few people find anything wrong with it.

One commenter wondered if some people too easily cry rape in the first place, adding:

if you look at those... [rape] studies, the guidelines are often fairly liberal...i.e. being drunk.

Rape is bad. Sometimes over-reported, sometimes under.

You don't know all the facts of this case, this poorly phrased question may have saved an innocent man 25 years in jail. Instead it ensured a guilty man 25 in jail. Good riddance.

what? when did being drunk become a good excuse to have sex with someone who doesn't consent? idiots like this judge and the commentator are the very reason why we aren't teaching our youth and each other about healthy consenting sex (regardless of intoxication) and instead letting people (not just men but women also) get away with getting drunk, assuming that means the other person wants sex, and going for it regardless of how their partner feels. agh!

I think that commenter was trying to say that not all drunken sex should be considered rape.

I should hope it isn't, or half of the patrons leaving my bar each night are rapists or rape victims...
